Local Law No. 2 of 2010
Planning Board Membership
Section 1.
Subsection 9-3(A) Local Law No. 2 of the Year 1987, as
amended, including Local Law No. 5 of the Year 1996 and Local Law No. 2 of the
Year 2003, is hereby amended, in part, to read as follows:
Creation, Appointment, and Organization:
1)
The Mayor shall appoint five (5) members, who shall be Village residents,
to the Village Planning Board as provided in §7-718 of the Village Law.
2) The Mayor shall make every reasonable
effort to appoint persons with an interest in the history and architecture of
the Village. Particular consideration shall be given to the appointment of
persons specially qualified through training or experience in history,
architecture, building construction, real estate, law, art, and the like. At
least one (1) member shall maintain legal residence or own property within the
Historic Preservation Overlay District.
3. Any vacancy occurring in a position for any reason other than expiration of
the term for which they were appointed shall be filled in accordance with
Section 7-718 of the Village Law.
Section 2.
Transitional Provisions. The purpose of this Local Law is to
decrease the membership on the Planning Board from seven (7) members to five
(5) members. Consistent with the provisions of Sections 7-706 and 7-718 of the
Village Law, this Local Law shall take effect upon publication and filing as
required by Section 7-706 of the Village Law and as follows. Upon the expiration
of the term of office for each current member of the Planning Board, his or her
successor shall be appointed for a five (5) year term, which shall expire at
the end of an official year. The existing offices of member of the Planning
Board whose terms expire on the last day of the Village's official year ending
in December 2010 and December 2011, shall cease to exist upon the expiration of
their current term.
Section 3. This Local Law shall take effect immediately upon
filing with the Secretary of State.
