VILLAGE OF SACKETS HARBOR

LAW #1 OF 1990

CONDUCT OF GAMES OF CHANCE WITHIN THE VILLAGE

 

 

Section 1. Title - This local law shall be known and cited as THE GAMES OF CHANCE LAW of the Village of Sackers Harbor.

 

Section 2. Definitions, As used in this Article - all words shall have the same meanings as those defined in Section 186 of General Municipal Law and. Title 9 of the New York Code of Rules and Regulations Section 5600-1.

 

Section 3. Games of Chance Authorized - Authorized organizations, may upon obtaining a license from the Village Clerk, conduct Games of Chance within the Village of Sackers Harbor as provided in Article 9-A of the General Municipal Law, the Rules and Regulations of the New York State Racing and Wagering Board, and as provided further in this Local Law.

 

Section 4. Restrictions - The conduct of Games of Chance shall be subject to the restrictions imposed by Section 189 of the General Municipal Law and the Rules and Regulations of the New York State Racing and Wagering Board.

 

Section 5.  Sunday Games - Games of Chance may be conducted on Sundays between the hour's of Noon and Midnight only, unless the following day is a legal holiday.    Notwithstanding the foregoing provisions of this section, no Games of Chance shall be conducted on Easter Sunday, Christmas Day, or New Years Eve Day.

 

Section. 6. Enforcement - The Chief of Police of the Village of Sackets Harbor shall exercise control and supervision over all Games of Chance conducted under a duly authorized license. The Chief of Police shall have all the powers and duties set forth in Article 9-A of the General Municipal Law.

 

Section 7.  Effective Date - This Local Law shall take effect immediately upon filing with the Office of the Secretary of State and the New York State Racing and Wagering Board, following its approval by a majority of the qualified voters of the Village of Sackets Harbor voting on a proposition submitted at an election to be held pursuant to the provisions of Section 23 of the Municipal Home Rule Law.
